The UK Spouse Visa Explained

The UK Spouse Visa, also known as the UK Partner Visa, allows foreign nationals to live in the UK with their British citizen or settled partner (someone with Indefinite Leave to Remain or EU Settled Status). The visa is initially granted for up to 2 years and 9 months, with the possibility of extension. After holding the visa for a specified period and meeting all criteria, you may apply for Indefinite Leave to Remain (ILR), which offers permanent residency without being subject to immigration control. Once you obtain ILR, you may also qualify to apply for British citizenship.

  • Your partner must be a British or Irish citizen, settled in the UK, hold pre-settled status, have refugee status or humanitarian protection, or hold a Turkish Businessperson or Turkish Worker visa.
  • Both you and your partner must be over the age of 18.
  • You and your partner must have met in person.
  • Your marriage or civil partnership must be legally recognised in the UK.
  • You must provide evidence that your relationship is genuine and ongoing.
  • Any previous relationships must have permanently ended.
  • You must have suitable accommodation in the UK for you and any dependents.
  • You must meet the necessary English language proficiency level.
  • You must meet a financial requirement, showing a minimum income of £29,000 per year or the required level of cash savings, unless exempt.

Application Process for a UK Spouse Visa

The general process for applying for a UK Spouse Visa involves the following steps:

1. Complete the Application Form

2. Pay the Application Fee and International Health Surcharge..

3. Submit Biometric Information

Attend an appointment at a UK visa application centre to provide fingerprints and a photograph or use the UK Immigration ID Check app to scan identity documents.

4. Upload Supporting Documents

5. Home Office Review 

The Home Office may request additional information during the processing period.

6. Decision Notification

If approved you will receive a visa and you’ll need to create a UKVI account (an eVisa).

Mandatory Tests for a UK Spouse Visa

To apply for a Spouse visa, you may need to complete the following mandatory tests:

Demonstrate proficiency in English by:

  • Passing an approved English test (CEFR level A1 or higher)
  • Holding a UK degree or equivalent qualification from a majority English-speaking country
  • Exemptions apply for individuals from specified English-speaking nations.
Tuberculosis (TB) Test Certificate: 
  • If you are applying from a country where TB testing is required, you must provide a valid TB test certificate from an approved clinic.
  • This applies to certain countries as specified by the UK government.

Meeting the Financial Requirement

To apply for a Spouse visa, unless exempt you must show a minimum income of £29,000 per year or the required level of cash savings.

Using Savings Instead of Income
  • If the sponsor (UK-based partner) does not meet the income requirement, they can use savings. 
 
Exempt from the minimum income requirement 
  • If the sponsor is on certain benefits they may be exempt from the minimum income requirement but must demonstrate they can financially support themselves and their partner.⁣

Decision Timelines

The Home Office typically processes spouse visa applications made from outside the UK within 12 weeks, although complex cases may take longer.
