FAQ

Frequently Asked Questions

We recommend starting your visa application preparation at least 6-8 weeks before your application date however, we can support applications in shorter timeframes. The amount of historical evidence needed depends on the type of visa you’re applying for. Most applications require supporting documents to prove you meet the eligibility criteria, such as proof of income or savings for the past 12 months or evidence of a relationship for at least two years for a partner visa.

Additionally, some visa routes may require applications to be submitted 60 days before your current leave expires or within three months of receiving a Certificate of Sponsorship (CoS). Planning ahead and gathering the necessary documents early can help ensure a smooth application process. To get started and learn more about the specific requirements for your application, we recommend booking a free review meeting.

Pre-Settled Status is a temporary status for eligible EU, EEA, and Swiss nationals who have lived in the UK for less than five years. It allows them to stay for up to five years, after which they can apply for Settled Status.

Leave to Remain refers to permission to stay in the UK. Limited Leave to Remain is temporary, while Indefinite Leave to Remain (ILR) allows permanent stay.

Settled Status is for eligible EU, EEA, and Swiss nationals who’ve lived in the UK for five continuous years and grants permanent residency. It’s similar to ILR but specific to those under the EU Settlement Scheme.

ILR grants permanent residency to non-EU nationals, but it can be lost if someone stays outside the UK for more than two years (or five years with Settled Status).

Not all UK visa routes lead to Indefinite Leave to Remain (ILR) or settlement. Some visas, like work or family visas, can lead to ILR after a certain period (usually five years). However, student visas don’t lead to ILR, and individuals would need to switch to a work visa or another route to stay longer. Temporary visas, like those for tourism or short business visits, don’t lead to settlement either. In some cases, visa holders may be able to apply for ILR by meeting specific eligibility criteria or changing to a visa that leads to settlement.

Indefinite Leave to Remain and Settled Status can be lost or revoked in certain situations, for example, it will lapse if you are outside the UK for more than two consecutive years (or five years if you have settled status under the EU Settlement Scheme). If this happens, you may need to apply for entry as a returning resident.

In contrast, British citizenship is permanent and cannot lapse due to time spent abroad. However, it can be revoked in rare cases, such as fraud in the application process or actions deemed seriously prejudicial to the UK.

The UK allows dual citizenship (also known as dual nationality), meaning you can be a British citizen while also holding citizenship of another country. However, you should check with the authorities of the other country, as not all nations permit dual citizenship.

The timing of your visa extension application depends on your specific visa route. For instance, a Spouse Visa extension must be submitted within 28 days of your current visa expiring, while a Skilled Worker extension must be completed within three months of being assigned a new Certificate of Sponsorship (CoS) or 60 days before the current leave expires, whichever comes first. To ensure you’re following the correct timeline and meeting all the requirements for your application, we recommend booking a free review meeting to get guidance tailored to your situation.
